General terms and conditions Mediconn

Definitions

  • Customer: the natural or legal person who purchases products from Mediconn.
  • Mediconn: the company Mediconn, based in Oss, the Netherlands, registered in the trade register under Chamber of Commerce number 96470771.
  • Agreement: any agreement between Mediconn and Customer regarding the delivery of products.
  • Product(s): the medical power supply cables, sockets, accessories and related goods offered by Mediconn.

Applicability

  • These general conditions apply to all offers, orders and deliveries of Mediconn.
  • Deviations from these terms and conditions are valid only if agreed in writing.
  • If any provision is found to be invalid, the remaining provisions will remain in full force and effect.

Offers and agreements

  • All offers are non-binding unless otherwise stated.
  • An agreement is established when Mediconn confirms an order in writing or when Mediconn begins implementation.
  • Customer guarantees the accuracy of data provided by him for the offer.

Prices and payment

  • All prices are in euros and do not include VAT, shipping and handling charges, if any.
  • Payment shall be made within the period indicated on the invoice.
  • In case of late payment, the Customer is legally in default and Mediconn may charge interest and collection costs.

Delivery

  • Delivery takes place ex Mediconn warehouse or via a carrier designated by Mediconn.
  • Stated delivery times are indicative.
  • Customer must report visible damage or defects within 3 days of receipt.

Retention of title

  • Products remain the property of Mediconn until Customer has fully fulfilled its payment obligations.
  • Customer may not pledge or encumber delivered products while the retention of title applies.

Warranty and conformity

  • Mediconn guarantees that products meet the agreed specifications and usual quality standards.
  • Warranty expires in case of improper use, lack of maintenance, or modifications by Customer.
  • Customer is responsible for use by qualified staff and in accordance with applicable medical and technical regulations.

Liability

  • Mediconn is not liable for indirect damage such as consequential damage, loss of profit or business interruption.
  • Liability is limited to the invoice amount of the relevant delivery or the insured amount.

Force majeure

In case of force majeure, obligations are suspended for as long as the force majeure continues. If the force majeure lasts longer than 60 days, the parties may dissolve the agreement in writing.

Mediconn processes personal data according to its privacy statement, available on the website.


Applicable law and disputes

These terms and conditions are governed by Dutch law. Disputes shall be submitted to the competent court in the Netherlands.

 

Changes to conditions

Mediconn may amend these terms and conditions. The most recent version is available on the website.
